European Court Makes Decision re Graphite Electrode Case

Showa Denko K.K. (SDK) has learned that the European Court decided on April 29 that the fine to be imposed on SDK pertaining to a case of graphite electrode cartel in Europe should be 10.44 million euros. The decision was made in response to SDK’s appeal against the European Commission’s notice to SDK in 2001.

SDK will carefully study the contents of the court decision and decide on how to respond, including the possibility of further appeal.

SDK has tentatively paid the fine in full amount. Even when the European Court’s decision on April 29 becomes binding, it will have no influence on SDK’s net income for 2004.
