SDK Files Patent Lawsuit at Düsseldorf Regional Court -- Calling for Cessation of Infringement and Claiming Damages --

Showa Denko K.K. (SDK) filed a lawsuit at Düsseldorf Regional Court of Germany on May 25 against Stuttgart-based Behr GmbH & Co. KG (Behr), seeking cessation of Behr’s infringement of SDK’s patent right and claiming damages.

The lawsuit pertains to SDK’s European Patent No. 0359358B2 (German Patent No. DE68926202T3) for SDK’s proprietary technology that enables the production of a condenser with improved heat exchange efficiency and small size as a result of optimization of the number of tubes through which coolant passes in its phase of being condensed from gas to liquid.

As part of the heat exchanger business, SDK manufactures and sells condensers for car air-conditioners and owns major patents for the product.

SDK believes that some of the condenser products manufactured and sold by Behr infringe on SDK’s patent. SDK began discussions with Behr in June last year and continued talks in good faith. However, after almost one year, Behr has failed to make a satisfactory reply. As the mutual consultation does not seem to settle the issue, SDK has decided to resort to legal proceedings.

SDK intends to take strong action against any cases of infringement of its patent rights.
